Terms of use

These Terms of Use form a contract in electronic form between you and Bimmer-Bids. They apply whether you use the Services as a buyer placing bids, a seller submitting a vehicle, part, or memorabilia listing, or a visitor in any other capacity (collectively, "Users").

The Services and all content provided through them — including text, photos, videos, comments, and listing data ("Content") — are for general informational purposes. The Services and Content are provided "as is" and your reliance on them is at your own risk.

Bimmer-Bids provides a platform that enables Users to list BMW vehicles, parts, and memorabilia for auction and to place bids on those listings. We are not the owner, seller, broker, dealer, or auctioneer of any listed item.

Sellers are solely responsible for ensuring their listings comply with all applicable laws and accurately describe the item. As a courtesy, Bimmer-Bids may assist sellers with listing creation (including AI-assisted descriptions), but the seller remains fully responsible for accuracy.

Buyer and seller settle payment and transport of the item directly with one another. Bimmer-Bids is not a party to the sale, does not act as an escrow agent, and does not process the purchase price of vehicles or items between users.

We collect and use information about you as described in our Privacy Policy, which is incorporated into and forms part of this Agreement.

All information you submit — during registration, listing submission, or otherwise — must be truthful, accurate, and current. If we believe it is not, we may suspend or terminate your access.

You agree to receive communications from us electronically (for example, by email or on-site notifications), and that such electronic communications satisfy any legal requirement that communications be in writing.

The Services are not directed to children under 13, and they may not use them. By using the Services, you represent that you have the legal capacity to enter into this Agreement. Minors may use the Services only with a parent or guardian who agrees to be bound by this Agreement on their behalf.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, whether or not authorized by you. Notify us immediately of any suspected unauthorized use.

If you use the Services on behalf of a company or other entity, you represent that you are authorized to bind that entity to this Agreement.

Each bid is a binding offer to purchase the listed item at the bid amount plus the applicable buyer's fee. Bids may not be retracted except within the published retraction window (if any) shown on the auction page.

Bids must meet or exceed the current high bid by at least the stated minimum increment. Bids placed in the final minutes of an auction extend the closing time according to the anti-sniping rules displayed on the auction page.

If a listing has a reserve and bidding ends below it, the lot closes unsold and neither party has a sale obligation. For no-reserve listings, the high bidder at close is obligated to complete the purchase.

Shill bidding — bidding on your own listing or having associates bid to inflate the price — is prohibited and results in permanent account removal and cancellation of affected bids.

Before your first bid you must accept the Bidder Agreement in your own full legal name and place a valid payment card on file. Accepting the Bidder Agreement electronically has the same legal effect as a handwritten signature.

You authorize Bimmer-Bids, LLC to verify that card and, if you win and do not pay the buyer's fee when due, to charge the buyer's fee to that card without further authorization.

If you are the high bidder on a closed lot that meets its reserve (or is offered at no reserve), you must confirm your purchase commitment in your account and pay the buyer's fee. Contact details for the other party are released only after that fee is paid.

If you fail to complete a purchase, we may charge the buyer's fee, suspend or terminate bidding privileges, cancel your other bids, relist the item, notify the seller, and pursue any other remedy available under Maryland law. The seller may also pursue you directly, as the sale contract is between you and the seller.

Disputes about non-payment or non-delivery are between buyer and seller. We may, at our discretion, provide records of bids, agreements, and commitments to either party or to a court.

Sellers must accurately disclose condition, history, damage, modifications, title status, and known faults. Required documentation, including a copy of the title for vehicle listings, must be genuine and current.

Bimmer-Bids may review, edit, delay, decline, or remove any listing at its discretion. Listing fees are due as described on the site and are non-refundable once a lot has been accepted.

Once a listing is live, the seller may not withdraw it to pursue an off-platform sale to a bidder, and may not circumvent the marketplace to avoid fees.

Buyer's and seller's fees are published on the site (currently on the How It Works and Sell pages) and may be updated prospectively. Fees are earned when charged and are non-refundable except where required by law.

You retain ownership of content you submit ("User Content"), but you grant Bimmer-Bids a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it in connection with operating and promoting the Services, including in past-results archives.

You represent that you own or have rights to your User Content and that it does not infringe any third party's rights or violate any law.

You may not: scrape or harvest data from the Services by automated means; interfere with or burden the Services; post unlawful, defamatory, or infringing content; harass other users; misrepresent your identity or an item's condition; engage in shill bidding or bid manipulation; or use the Services to facilitate off-platform circumvention of fees.

The Services may link to or integrate third-party services (for example, vehicle-history providers, video hosts, or financing tools). We are not responsible for third-party sites or services, and your dealings with them are solely between you and the third party.

You release Bimmer-Bids and its officers, employees, contractors, and agents from all claims arising out of disputes between you and any other user or third party relating to your use of the Services.

You agree to indemnify and hold Bimmer-Bids harmless from any claim, loss, liability, and expense (including reasonable attorneys' fees) arising from your use of the Services, your User Content, your violation of this Agreement, or your violation of any law or third-party right.

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Bimmer-Bids makes no warranty regarding any vehicle, part, or item listed, any listing's accuracy, or any transaction between users.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bimmer-Bids will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, arising from your use of the Services. Our aggregate liability to you for any claim arising from this Agreement will not exceed the greater of the fees you paid to us in the twelve months preceding the claim or one hundred U.S. dollars (US $100).

We may suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including conduct we believe violates this Agreement or harms other users or the marketplace.

This Agreement is governed by and construed exclusively under the laws of the State of Maryland, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to this Agreement or the Services will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction and venue of those courts.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent needed to make it enforceable.

If you believe content on the Services infringes your copyright, notify us through the in-site support tool with a description of the work, the location of the infringing material, and your contact information, and we will respond in accordance with applicable law.

We may revise these Terms of Use prospectively by posting an updated version on the Services. Your continued use after a revision takes effect constitutes acceptance of the updated terms.

This Agreement, together with the Privacy Policy and any feature-specific rules, is the entire agreement between you and Bimmer-Bids regarding the Services and supersedes any prior understandings.
